  • No Statute of Limitations for First-Degree Assault: In actions for personal injury based on events for which the actor was convicted of first-degree sexual assault, there is no statute of limitations.Conn. Gen. Stat. §52- 577e
  • 30 Year Delayed Statute of Limitations for Victims under Age 18 : 18 + 30 years for offenses which did not lead to first-degree criminal conviction, Conn. Gen. Stat. §52-577d

  • No Discovery Rule : See, e.g., Rosado v. Bridgeport Roman Catholic Diocese Corp., 1997 Conn. Super. LEXIS 2496 (Conn. Super. Ct. Sept. 15 1997).

  • Retroactive : The 30 year delayed statute of limitations, enacted in 2002, has recently been applied retroactively by the state’s highest court. See Doe v. Norwich Roman Catholic Diocesan Corp., 279 Conn. 207 (2006).
  • General Negligence unrelated to Child sex abuse: 2 years from discovery with no more than 3 years from act or omission.

  • Tolling: “If any person, liable to an action by another, fraudulently conceals from him the existence of the cause of such action, such cause of action shall be deemed to accrue against such person so liable therefore at the time when the person entitled to sue thereon first discovers its existence."
    Conn. Gen. Stat. § 52-595 (2010)

  • Action to Recover for Personal Injuries: An action to recover damages for personal injury caused by sexual assault may be brought at any time after the date of the act complained of if the party legally at fault for such injury has been convicted of first-degree aggravated sexual or sexual assault (citing 53a-70 and 53a-70a)

Exceptions:  Yes
  • No Statute of Limitations for Class A Felony Sexual Offenses; 5 year Statute of Limitations for Most Others : See Conn. Gen. Stat. § 54-193(a).


    • Class A felony sexual offenses include first-degree and aggravated sexual assault if the victim is less than 16 years old, §§ 53a-70, -70a, and employment of a minor in an obscene performance, § 53a-196a.


    • All felonious sexual offenses are or may be punished with imprisonment in excess of 1 year, e.g. § 53a-71 (sexual assault in the second degee), § 53a-191 (incest), and therefore carry 5 year statutes of limitations. § 54-193(b).


    • Other sexual offenses (i.e. misdemeanor) must be prosecuted within 1 year of the offense. Id.
       
  • Delayed Statute of Limitations for Sexual Abuse of Minors: 30 Years : Prosecutions for sexual abuse of minors may be pursued within 30 years of the date the victim attains the age of majority (18), or within 5 years of the date the crime is reported to any police officer, whichever is earlier. Conn. Gen. Stat. § 54-193a.
